Privacy Policy
Information supplied to us will only be used to notify you of bannerart product updates or events, and will not be sold or passed on to any third party. No credit or debit card information will be held on this site, all transactions are made independently through our payment services provider on our behalf, and for your added security.
Legal Compliance
The Banner Art returns and refunds policy is in accordance with the EU Distance Selling Directive which came into force in October 2000 and is part of UK law under the Consumer Protection (Distance Selling) Regulations 2000. This law applies to all transactions within the UK where a consumer does not meet the vendor. Contracts between businesses are not governed by these regulations.
1. Conditions
1. These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer to the exclusion of all other terms and conditions including any terms or conditions that the buyer may purport to apply under any purchase order, confirmation of order or similar document.
2. All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and shall only be accepted by means of the Sellers standard acknowledgement form.
3. Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyers acceptance of these Terms and Conditions.
4. Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
2. The Goods
1. Colours depicted on banners on this website are for guidance only. Colours cannot be matched exactly due to discrepancies between screen and print colour representation. However, every effort will be made to match colours as exactly as possible. Please see our FAQs for more details on this matter.
2. All banner sizes are quoted in feet and meters for your convenience. Within the banner will be incorporated a discreet footer with the legend Designed online at: www.bannerart.co.uk and similar around the hem on the reverse side of the banner. In certain circumstances it is possible to remove this information, this service will incur an additional cost, please contact us for more information
3. The design of www.bannerart.co.uk and the banners contained therein are the sole property of Banner Art Ltd. Any unauthorised reproduction of the designs or the website will result in legal action. If you feel that we have in any way breached your copyright please contact us immediately and we will do our best to resolve any issues. bannerart.co.uk ltd disclaims any liability for artwork supplied by customers. As a customer, it is your responsibility to ensure that you have authorization to use any uploaded imagery. bannerart.co.uk Ltd assumes you hold the necessary copyright and cannot be held responsible for lible actions as a consequence of breaches of this legal requirement. All legal inquiries from third parties will be forwarded onto you.
4. Please note that whilst we respect your rights to freedom in design, we do reserve the right to refuse to produce banners that contain imagery and or text that is considered profain or extreme in its content. Therefore swear words, scenes of nudity and content that breaches the rights of any individual may be refered back to you for revision and resubmission.
5. We shall not be liable to you for any damages, costs, losses (including without limitation pure economic loss, loss of profit, loss of business, interruptions to business, depletion of goodwill or reputation, and/or loss of commission), claims or liabilities, whether direct, indirect or consequential, arising from failure of our product for whatever reason, or from any action taken as a result of your use of the product.

7. Following your acceptance of these terms and conditions, you shall be entitled to use the services in accordance with this agreement, as amended from time to time. If at any point you do not agree with or accept the terms and conditions you must cease using the services immediately. We reserve the right to amend these terms and conditions in compliance with current UK & EU law. These terms do not affect your statutory rights
3. Orders
1. Sometimes stock may be withdrawn or discontinued. We shall make every effort to update the website at all times, but you understand and acknowledge that we are not liable to you for any failure or delay to fulfill an order due to products being out of stock, withdrawn or discontinued.
2. Once an order has been placed by you and accepted by us you have no right to cancel the order, except at our discretion in exceptional circumstances. Once we have dispatched the products we are unable to cancel any orders.
3. We shall endeavor that all orders are met. We do not, however, guarantee the availability of any product at any time. Where a product is temporarily out of stock we will advise you of when we expect to be able to fulfill orders, however this is an estimate only and shall not be binding upon us.
4. Price And Payment
1. Payment for the price of the products shall be due in pounds sterling at the time of the order.
2. The Price shall be that in the Sellers current List Price, or such other price as the parties may agree in writing. The Price displayed is inclusive of VAT and any analogous sales tax, carriage, freight, postage or insurance costs.
3. Prices for delivery are displayed alongside price of goods All UK mainland deliveries are free of charge. The total cost displayed at the checkout is inclusive of VAT and any other fees implied.
4. Payment of the Price and VAT and any other applicable costs shall be due within 30 days of the date of receipt of the invoice supplied by the Seller if electronic payment is not made at the time of order.
5. Delivery
1. Delivery is only available to UK mainland customers via our selected courier service weekdays only and will cost £5. In certain circumstances a weekend delivery can be arranged. This service will incur an additional cost (please contact us for more information). Banners will normally be delivered within 5 working days after receipt of payment.
2. Unless otherwise agreed, delivery of the Goods shall take place at the address specified in the Buyers Purchase Order on the Delivery Date and the Buyer shall be deemed to have accepted the Goods upon their delivery. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
3. The Delivery Date specified by the Seller is an estimate only. Time for delivery shall not be of the essence of the Contract.
4. Subject to the other provisions contained in these terms and conditions, we shall not be liable for any direct, indirect or consequential loss (all three terms which include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar losses), costs, damages or expenses caused directly or indirectly by any delay in the delivery of the products (even if caused by our negligence).
5. If for any reason you or the person at the delivery address refuses to accept delivery of the products, all risk in the products shall pass to you and we may, at our discretion, charge for return of the products to us, a storage fee and a redelivery fee to another address nominated by you.
6. The cost of delivery shall be calculated when you place your order with us and payment shall be due at the time of payment for the products.
6. Warranties
1. All warranties, conditions and other terms implied by state or common law are, to the fullest extent permitted by law, excluded from this Agreement.
2. All products carry the warranty stated on the product description.
3. In the event of the product requiring replacement or repair under the warranty, you must contact the manufacturer directly.
7. Returns, Cancellations & Refunds
1. In the unlikely event of your purchase arriving damaged we will make every effort to ensure that you receive a timely replacement.
At Banner Art we pride ourselves on top quality print and customer service. However, we are only human and mistakes occasionally can occur. If we have incorrectly printed your banner then we will happily offer you a reprint or refund your money.
Mistakes while ordering can also happen, so please take the time to double check your details before submitting your order. Details cannot be changed once we have received your order.
2. In the event that any order is incorrect, it must be notified to us within 7 (seven) days after delivery.
3. In the case of incorrect orders, the products shall be returned to us and we shall redeliver the correct order at our own cost.
4. If any products are faulty or defective, they must be returned to us within 1 (one) month of delivery. At our own discretion, we shall replace or repair the products free of charge and redeliver them at our own cost, or shall provide a refund or the price paid by you. In the event of replacement of any products, the products returned to us shall become our property.
5. If we elect to refund you rather than provide a replacement or repair for faulty or defective products, or we are unable to replace any faulty or defective product, the products must be returned to us, at our cost, and shall become our property.
6. If, for any reason, you wish to cancel your order please contact us as quickly as possible. If your banner has not reached production, we will cancel the order and refund your money.
Please be aware that each banner is individual to the buyer so reselling the banner is almost impossible.
This does not affect your statutory rights.
